    Terms of Service

    1. Who we are

    Endurio provides an AI powered endurance training coach that you interact with through a chat interface, including over WhatsApp. The service delivers personalized training plans, day to day coaching, workout schedules and related features (together, the "Services").

    2. Acceptance of these terms

    These Terms of Service ("Terms") form a binding agreement between you and Endurance Intelligence Ltd ("Endurio", "we", "us" or "our"). By messaging our chatbot, creating a profile or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

    3. Eligibility

    You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services. By using the Services you represent that you meet this requirement and that the information you provide is accurate and belongs to you.

    4. The Services and how they work

    The Services use large language models and automated tools to generate coaching responses and training content. Depending on the features you use, the Services may:

    • Onboard you through a guided conversation and collect your fitness level, goals, target event, schedule and availability.
    • Generate a personalized training plan and workout schedule, and produce a downloadable PDF of that plan.
    • Answer training questions, explain workouts and adjust or reschedule sessions in response to your messages.
    • Look up public information such as race dates and event details using web search to help build your plan.
    • Send you messages, reminders and daily summaries through your chosen chat channel.

    Coaching content is generated automatically and may contain errors, omissions or inaccuracies. It is general guidance only and is not a substitute for professional, medical or individualized advice. You are responsible for reviewing recommendations before acting on them.

    5. Messaging and WhatsApp

    • You interact with the Services by exchanging messages through third party messaging platforms such as WhatsApp, which are operated by their own providers and subject to their terms and privacy policies.
    • By providing your phone number and messaging us, you consent to receive automated and coaching related messages from the Services. Standard message and data rates from your carrier may apply.
    • You can stop receiving messages at any time by following the opt out instructions in the chat or by contacting us. Opting out may limit or end your ability to use the Services.
    • We are not responsible for delays, failures or downtime caused by the messaging platform, your carrier or your device.

    6. Medical disclaimer and assumption of risk

    Endurance sport training, including running, cycling, swimming and strength work, is physically demanding and carries inherent risks of injury, illness and, in rare cases, death. You participate at your own risk.

    The Services are for general fitness and informational purposes only and do not provide medical advice, diagnosis or treatment. Consult a qualified physician before starting any training program, especially if you have a medical condition, are pregnant or have any concerns about your health. Stop exercising and seek medical help immediately if you experience pain, dizziness, shortness of breath or other warning signs.

    You certify that you are in good health and physically able to undertake the training suggested by the Services. Endurio does not monitor your physical condition and has no duty to provide medical assistance or emergency response.

    7. Third party integrations

    You may choose to connect third party services to enrich your coaching experience, such as Garmin Connect for activity and performance data and Google Calendar for scheduling. When you connect an integration:

    • You authorize us to access and use the data and permissions you grant, solely to provide the Services, for example importing workouts and metrics, writing workout events to your calendar and proposing schedule adjustments.
    • Your use of each third party service remains subject to that provider's own terms and privacy policy.
    • You can disconnect an integration at any time through your settings or the third party service, after which we stop future syncing. How we handle your data is described in our Privacy Policy.

    8. Subscriptions, billing and Plus features

    • Some features are free, while others (for example certain premium or "Plus" features such as advanced integrations) require a paid subscription.
    • Paid subscriptions are processed by our third party payment provider, Stripe. By subscribing, you authorize recurring charges to your chosen payment method until you cancel.
    • Subscriptions renew automatically for the applicable billing period unless cancelled before the renewal date. You can manage or cancel your subscription through the billing portal or by contacting us.
    • Fees are stated at the point of purchase and may change on notice for future billing periods. Except where required by law, payments are non refundable and cancellation stops future charges without refunding the current period.
    • If a payment fails or a subscription lapses, we may suspend or downgrade access to paid features.

    9. Acceptable use

    You agree not to:

    • Use the Services for any unlawful, harmful, fraudulent or abusive purpose, or in violation of any third party platform's rules.
    • Attempt to disrupt, overload, reverse engineer, scrape or gain unauthorized access to the Services or their underlying systems.
    • Submit content that infringes others' rights or that is false, misleading or belongs to someone else without permission.
    • Rely on the Services for emergencies or as a substitute for professional medical, legal or financial advice.
    • Resell, redistribute or commercially exploit the Services or the content they generate without our written consent.

    10. Your content and license

    You retain ownership of the information and content you submit to the Services ("Your Content"). You grant us a worldwide, non exclusive, royalty free license to use, process, store and transmit Your Content as needed to operate, provide, secure and improve the Services. You are responsible for Your Content and confirm you have the rights necessary to share it with us.

    11. Intellectual property

    The Services, including the software, chatbot, training plans, generated content, text, graphics and underlying methodology, are owned by Endurio or its licensors and protected by intellectual property laws. Certain training methodology and reference materials may be licensed from third parties. We grant you a limited, non exclusive, non transferable and revocable license to use the Services and the plans generated for you for your personal, non commercial training. All rights not expressly granted are reserved.

    12. Service availability and changes

    We may add, change, suspend or discontinue any part of the Services at any time, and we may set limits on features or usage. The Services depend on third party providers (including messaging, hosting, payment, AI and integration partners) and may be unavailable or interrupted. We do not guarantee that the Services will be uninterrupted, timely, secure or error free.

    13. Disclaimer of warranties

    To the maximum extent permitted by law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non infringement. We do not warrant that the Services, coaching responses or training plans will meet your needs, be accurate or reliable or produce any particular fitness or performance result. Results depend on many factors, including your adherence, fitness, health, diet and rest.

    14. Limitation of liability

    To the maximum extent permitted by law, Endurio and its officers, employees, agents and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or personal injury, arising out of or related to your use of, or inability to use, the Services. To the extent liability cannot be excluded, our total liability for all claims relating to the Services is limited to the greater of the amounts you paid us in the twelve months before the claim or USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

    15. Indemnification

    You agree to indemnify and hold harmless Endurio and its officers, employees, agents and affiliates from any claims, losses, liabilities, damages and costs (including reasonable legal fees) arising from your use of the Services, Your Content or your violation of these Terms or applicable law.

    16. Suspension and termination

    You may stop using the Services at any time and request deletion of your data as described in our Privacy Policy. We may suspend or terminate your access if you breach these Terms, misuse the Services or where required by law. Provisions that by their nature should survive termination will continue to apply.

    17. Changes to these terms

    We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date and, where appropriate, notify you. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

    18. Governing law and disputes

    These Terms are governed by the laws applicable to Endurance Intelligence Ltd, without regard to conflict of law principles. You agree to first contact us to try to resolve any dispute informally. Any dispute that cannot be resolved will be subject to the courts having jurisdiction over Endurance Intelligence Ltd, unless mandatory local law provides otherwise.

    19. General

    If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and Endurio regarding the Services. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
